Terms of Service
1. Definitions
"Owner" means the content
provider of this site including Newport and Jackson County, Arkansas,
the UALR Institute for Economic Advancement,
the Arkansas Department of Economic Development, the Arkansas Department
of Employment Security, and Southwestern Bell Communications. "User"
means each person who establishes a connection or uses information
contained within this site in any form.
2. General
By using this site, user agrees to comply with the statement
herein. The user is responsible for ensuring compliance with this and
all other agreements entered into on other portions of this site.
3. User Conduct
Users may not modify, publish, transmit, participate in the transfer
or sale, create derivative works, or in any way exploit, any of the
content, in whole or in part.
Users shall not post or transmit through this site any material that
is unlawful, threatening, abusive, defamatory, invasive of privacy or
publicity rights, vulgar, obscene, profane or otherwise objectionable.
4. Warranties
This information is provided "as is" with no expressed or implied
warranties. This includes warranties of title, fitness for a
particular purpose or merchantability. The information contained herein
is deemed reliable and accurate at the time of publication. The user
has the final duty in determining the accuracy of this data.
User agrees to defend, indemnify and hold harmless the owners, their
affiliates, respective directors, officers, employees and agents from
and against all claims and expenses, including attorneys' fees, arising
out of the use of this site.
5. Termination
This agreement is subject to termination at will by either party without
notice. The owners will have the right to immediately terminate user's access
privileges in the event of any conduct by user that the owners consider to be
unacceptable, or in the event of any breach by user of this agreement.
6. Miscellaneous
This agreement along with any future authorized agreements are the
sum total of these terms of service. This agreement supercedes all
previous written agreements and all previous or subsequent oral
agreements. The owners reserve the right to update this agreement at
any time. This agreement will be construed in accordance with the laws
of the state of Arkansas and Arkansas law will govern any disputes.
If any part of this agreement is deemed invalid or in conflict with federal it
is severed from the agreement and the remaining portion maintains its full force
and validity.

8. Effective Date
The text of this agreement was last modified on Thursday, July 11, 2002 and
was incorporated and effective immediately thereafter. For the purposes
of acceptance, the intial reading and continued use of this site after
this date constitute an agreement to the terms therein and this
agreement between the owners and the user.
